Terms and Conditions

1. General Terms 1.1. In these Online Shopping Terms and Conditions and the Herbap Matrix Online Store Special Terms (hereinafter collectively referred to as the “Terms and Conditions”), “Herbap Matrix” or “we” refers to the business entity of Herbap Matrix, and “Customer” or “you” refers to any individual, organization or company that places an order for goods or services with us. Please read these Terms and Conditions carefully before using this website. By using this online store or any part thereof, you acknowledge that you have read, accepted and agreed to be bound by these Terms and Conditions. 1.2. We will make every effort to ensure that the prices, information and sizes of the products listed on the online store are up to date. We reserve the right to change product prices without prior notice. All orders are subject to our final decision and stock availability. 1.3. We will endeavour to ensure that the products listed on the online store are in stock. If a product cannot be supplied due to shortage of stock, we will cancel the order and arrange a refund. 1.4. All orders are subject to final confirmation and the availability of the relevant products. If we are unable to supply any ordered product or service, we have the right to refuse to accept the order.

2. User Registration 2.1. You must first register as a user on this website before you can order products or services from the online store. When registering, you undertake to:

• Provide true, accurate, up-to-date and complete personal information when requested by us;
• Ensure the security of your username and password;
• Ensure that only you or authorized persons use your username and password to log in to the online store;
• We have absolute discretion to refuse any new user application and may terminate any registered user without giving reasons.

2.2. If there are any changes to your registration information, you may log in to your account to update it yourself, or immediately notify Herbap Matrix Customer Service by telephone or email so that we can provide the latest information. 2.3. If your account has not been used for a certain period of time (currently 3 years), in order to protect the interests of both you and us, we will regard the account as deactivated and cancel it. All points and/or e-coupons in the account will be cancelled (if applicable). If you wish to shop at the online store again, you will need to apply for a new account.

3. Privacy Protection In order to protect your privacy rights in relation to personal data, we ensure that our policies and practices in the collection, use, storage, transfer and access of personal data comply with the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong). Please refer to our Privacy Policy Statement.

4. Payment Methods 4.1. The online store accepts payment by PayMe, Faster Payment System (FPS) and other designated electronic payment methods specified by us. All product prices are calculated in Hong Kong Dollars. Product prices on the online store may differ from those in physical stores. All prices are based on the prices displayed on the online store on the day you place the order. 4.2. All online orders are subject to stock availability and our final decision on acceptance. When you receive the products (via SF Express, self-pickup points, Tsim Sha Tsui store or Kwai Chung office), you will receive an official shopping receipt for record purposes.

5. Other Matters 5.1. Basis of Sale: We only sell and deliver products to end consumers. Orders for resale purposes are not accepted. If we have reasonable grounds to believe that you are not purchasing the products for personal use, we have the right to refuse or cancel the order. 5.2. Force Majeure: If we are unable to accurately provide products or services due to force majeure (including natural disasters, fire, flood, accidents, riots, war, government policies, embargoes, strikes, labour problems, equipment failure or other circumstances beyond our control), we shall not be liable to you or any third party. 5.3. Without our prior written consent, you may not assign, transfer or otherwise dispose of any rights and obligations under these Terms and Conditions to others. 5.4. If any provision of these Terms and Conditions is determined to be illegal or invalid, that provision shall be deleted, but this shall not affect the legality, validity and enforceability of the remaining provisions. 5.5. These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements, representations, understandings and arrangements. 5.6. We reserve the right to modify, amend or supplement all or any part of these Terms and Conditions at any time by giving prior notice. 5.7. In the event of any dispute, we reserve the final decision. 5.8. These Terms and Conditions shall be interpreted in accordance with the laws of the Hong Kong Special Administrative Region of the People’s Republic of China, and both parties shall submit to the exclusive jurisdiction of the Hong Kong courts. We may amend these Terms and Conditions at any time without prior notice.

6. Ordering Information 6.1. This online store only accepts orders with delivery addresses in Hong Kong, or orders for self-pickup at the designated Kwai Chung office building or Tsim Sha Tsui store. 6.2. When you place an order with us, you agree to make a purchase request to us in accordance with these Terms and Conditions and authorize us to deliver the products to the delivery address designated by you. After receiving your order, we will notify you to confirm receipt of the order. This notification does not mean that we have accepted the order. If we are unable to supply the products or services ordered by you, or due to credit card payment problems or other reasons, we have the right to refuse the order. If we are unable to supply the products, we will notify you by telephone or email. 6.3. After we accept your order, we will send you a confirmation notice and inform you of the delivery / self-pickup time and location (Tsim Sha Tsui store / Kwai Chung office). 6.4. If a free gift is included with the product you ordered and the gift is out of stock, we will notify you, and you may choose to accept another gift, cancel the order, or continue to purchase the product. 6.5. How to Purchase? Online Ordering: Delivery throughout Hong Kong with fast arrival

• Shipping Fee: Free shipping for a single order with a discounted amount of HK$300 or above; shipping fee of HK$50 will be charged if less than HK$300
• Delivery methods available: “SF Express – Delivery”, “SF Station / Self-pickup”, “Tsim Sha Tsui Store Self-pickup” or “Kwai Chung Agent Self-pickup”
• Product prices are displayed in: Hong Kong Dollars (HKD)

6.6. Payment Methods: Credit Card Payment – After payment is completed, Herbap Matrix will notify you by email and ship the goods within 3 to 7 working days – Accepts VISA / MasterCard / American Express

PayMe Payment – Use the PayMe application to scan the PayCode, enter the correct bank code, and fill in the reference number in the remarks field for our verification – After the transaction is completed, Herbap Matrix will notify you by email and ship the goods within 3 to 7 working days

FPS Payment – Use mobile banking to scan the FPS Code, enter the correct bank code, and fill in the reference number in the remarks field for our verification – After the transaction is completed, Herbap Matrix will notify you by email and ship the goods within 3 to 7 working days

6.7. Delivery Time: – After receiving the shipping notice, you can receive the goods within 3 to 7 working days – If the order encounters public holidays or bad weather, the delivery time will be postponed – Before shipping, Herbap Matrix will check stock availability and reserves the right to cancel the order

7. Product Ownership 7.1. Ownership of the products will be transferred after the customer has paid the full amount of the goods; ownership and risk of the products will be transferred to the customer when the products are delivered to the courier. 7.2. If the products are not collected within 30 days from the date of order confirmation, we have the right to destroy such products without further notice. In this case, we will not make any refund or any form of compensation, and reserve the right to continue to charge storage fees. 7.3. Under no circumstances shall we be liable to you for any loss of income (whether direct or indirect), loss of profits or any indirect or consequential loss arising from transactions with us.
